These Official Sweepstakes Rules (“Official Rules”) govern the NUGGETS NIGHT VISION CLASSROOM Sweepstakes (the “Sweepstakes”), sponsored by Nuggets Night Vision (“NNV” or “Promoter”).

By entering the Sweepstakes, each participant (“Participant” or “you”) agrees to be bound by these Official Rules and by the decisions of NNV, which are final and binding on all matters relating to the Sweepstakes, to the extent permitted by applicable law.

1. Sweepstakes Period

Each Sweepstakes associated with a Webinar begins when the applicable Webinar is made available on the Nuggets Night Vision website and ends when the final available seat for that Webinar is claimed, unless a different closing date and time are stated in the applicable Webinar description (the “Sweepstakes Period”).

All times referenced in these Official Rules will be based on the applicable time zone stated by NNV on the Website.

NNV reserves the right to modify, extend, suspend, or terminate a Sweepstakes when permitted by applicable law.

2. Definition of Webinar

For purposes of these Official Rules, “Webinar” means a webinar made available through the Nuggets Night Vision website at:

Each Webinar may have its own associated Sweepstakes and Prize, as described on the Website.

3. Eligibility

The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are at least eighteen (18) years of age at the time of entry.

Employees, officers, directors, and agents of NNV, its affiliates, partners, advertising and promotional agencies, and other companies or individuals directly involved in the administration of the Sweepstakes, as well as their immediate family members and members of their households, are not eligible to enter or win.

For purposes of these Official Rules, “immediate family members” includes a spouse, parents, siblings, children, and grandparents.

The Sweepstakes is subject to all applicable federal, state, and local laws and regulations and is void where prohibited or restricted by law.

NNV reserves the right to verify the eligibility of any Participant or potential Winner at any time.

4. How to Enter

There are two methods of entry.

A. Webinar Entry

During the applicable Sweepstakes Period, an eligible Participant may enter the Sweepstakes by:

  1. visiting the Nuggets Night Vision website;
  2. selecting the applicable Webinar;
  3. following the on-screen instructions;
  4. providing all required information; and
  5. completing the required entry process.

An eligible Participant who completes the required entry process will receive one (1) entry into the Sweepstakes associated with that Webinar.

Limit: One (1) entry per person per Webinar.

No purchase is necessary to view the Webinar or enter the Sweepstakes.

B. Free Mail-In Entry

An eligible Participant may alternatively enter without purchasing anything or viewing the Webinar by submitting a handwritten entry.

The Participant must write the following information on a plain 3-inch by 5-inch card:

  • Full name
  • Complete mailing address
  • Email address
  • Telephone number
  • Exact name of the applicable Webinar followed by the words “SWEEPSTAKES”

The card must be mailed in a properly addressed, stamped envelope to:

Each properly completed mail-in entry will count as one (1) entry into the Sweepstakes associated with the applicable Webinar.

Mail-in entries must be received before the applicable Sweepstakes Period closes.

Each mail-in entry must be individually handwritten and mailed separately. Mechanically reproduced, photocopied, computer-generated, mass-produced, or otherwise duplicated entries are void.

NNV is not responsible for lost, late, incomplete, illegible, damaged, misdirected, postage-due, or otherwise undeliverable mail.

C. Entry Limit

Regardless of the method of entry, each person is limited to one (1) entry per Webinar.

Entries exceeding the stated limit will be void.

A Participant may not enter the same Sweepstakes using multiple names, email addresses, physical addresses, accounts, identities, or other methods for the purpose of circumventing the entry limit.

Entries generated by scripts, bots, macros, automated systems, robotic means, or other artificial or automated methods are void.

NNV reserves the right to disqualify any person who attempts to circumvent these Official Rules or who uses fraudulent, deceptive, abusive, or otherwise improper means to enter.

5. Entry Requirements

All entries must be complete and accurate.

NNV reserves the right, in its sole discretion and to the extent permitted by law, to disqualify any entry or Participant that:

  • contains false, misleading, or incomplete information;
  • violates these Official Rules;
  • is submitted after the applicable deadline;
  • is submitted through unauthorized or automated means;
  • contains malicious, threatening, abusive, obscene, or harassing material;
  • tampers with the operation of the Sweepstakes;
  • attempts to obtain an unfair advantage; or
  • otherwise interferes with the administration, security, fairness, or integrity of the Sweepstakes.

NNV’s computer system is the official timekeeping device for online entries.

6. Odds of Winning

Odds of winning depend on the total number of eligible entries received for the applicable Sweepstakes.

Each valid entry will have an equal chance of being selected.

7. Prize

The Prize for each Sweepstakes will be the specific product or other item identified in the applicable Webinar description on the Nuggets Night Vision Website (the “Prize”).

The approximate retail value (“ARV”) of the Prize will be stated in the applicable Webinar description when required by applicable law.

The Prize is non-transferable and may not be sold, assigned, or redeemed for cash, except as expressly permitted by NNV or required by applicable law.

NNV reserves the right to substitute the Prize with another prize of equal or greater approximate retail value if the advertised Prize becomes unavailable for any reason.

Any difference between the actual value of the Prize and its stated ARV will not be awarded.

The Winner is solely responsible for all federal, state, and local taxes, fees, and other costs associated with acceptance, possession, or use of the Prize unless expressly stated otherwise.

8. Random Drawing

A random drawing will be conducted by NNV or its designated administrator within five (5) business days after the applicable Sweepstakes Period closes.

One (1) potential Winner will be selected at random from among all eligible entries received for the applicable Sweepstakes.

The potential Winner is subject to verification of eligibility and compliance with these Official Rules.

NNV’s decisions regarding the selection and verification of potential Winners are final and binding, subject to applicable law.

9. Winner Notification and Verification

The potential Winner will be notified using the email address, telephone number, or mailing address provided at the time of entry.

The potential Winner may be required to complete and return an Affidavit of Eligibility, Liability/Publicity Release, tax forms, and/or other documentation reasonably requested by NNV.

Unless otherwise prohibited by law, the potential Winner must complete all required documentation and claim the Prize within thirty (30) days after the date the initial notification is sent.

If a potential Winner:

  • cannot be contacted;
  • does not respond within the required period;
  • fails to provide requested information;
  • fails to complete required documentation;
  • is determined to be ineligible;
  • violates these Official Rules; or
  • declines the Prize,

the Prize may be forfeited.

If permitted by applicable law, NNV may select an alternate potential Winner by random drawing from the remaining eligible entries.

A person is not considered the official Winner until NNV has completed the verification process.

10. Prize Conditions

The Prize is awarded “AS IS,” without any express or implied warranty, except where such warranties cannot legally be excluded.

NNV is not responsible for any manufacturer’s warranty, guarantee, defect, malfunction, or other issue relating to the Prize. Any applicable warranty or guarantee shall be between the Winner and the manufacturer or applicable provider.

The Winner is responsible for the safe, lawful, and proper use of the Prize.

NNV is not responsible for any costs or expenses associated with the acceptance, possession, transportation, installation, maintenance, or use of the Prize unless expressly stated otherwise.

11. Publicity

Subject to applicable law, acceptance of a Prize constitutes permission for NNV to use the Winner’s name, photograph, likeness, voice, and state of residence for Sweepstakes-related publicity, advertising, and promotional purposes in any media, worldwide, without additional compensation, unless prohibited by law.

Where required by law, NNV will obtain any additional consent necessary before making a particular use of a Winner’s information.

12. Participant Submissions

If a Participant voluntarily submits photographs, videos, written materials, testimonials, comments, reviews, or other content in connection with the Sweepstakes (“Submission”), the Participant represents and warrants that:

  1. the Participant owns the Submission or has all necessary rights and permissions to submit it;
  2. the Submission does not violate any third-party copyright, trademark, privacy, publicity, or other rights;
  3. the Submission does not contain unlawful, threatening, defamatory, obscene, or otherwise objectionable material; and
  4. the Submission complies with all applicable laws.

To the extent permitted by law, by submitting content in connection with the Sweepstakes, the Participant grants NNV a non-exclusive, worldwide, royalty-free license to reproduce, display, distribute, and use the Submission for purposes reasonably related to administering, promoting, or publicizing the Sweepstakes and Nuggets Night Vision.

NNV is under no obligation to use any Submission.

13. Release

To the fullest extent permitted by applicable law, by entering the Sweepstakes, each Participant agrees to release and hold harmless NNV and its affiliates, partners, employees, officers, directors, agents, representatives, and assigns (collectively, the “Released Parties”) from and against claims, liabilities, damages, losses, costs, or expenses arising out of or relating to:

  • participation in the Sweepstakes;
  • any violation of these Official Rules by the Participant;
  • acceptance, possession, use, misuse, or inability to use the Prize;
  • any technical malfunction or interruption;
  • any unauthorized human intervention in the Sweepstakes;
  • any error in the administration of the Sweepstakes; or
  • any other matter arising from or relating to the Sweepstakes,

except to the extent caused by conduct for which liability cannot legally be excluded or limited.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE RELEASED PARTIES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO THE SWEEPSTAKES, THESE OFFICIAL RULES, OR THE ACCEPTANCE, POSSESSION, OR USE OF ANY PRIZE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE TOTAL LIABILITY OF THE RELEASED PARTIES ARISING OUT OF OR RELATING TO THE SWEEPSTAKES WILL NOT EXCEED THE ACTUAL RETAIL VALUE OF THE PRIZE AT ISSUE OR FIVE HUNDRED DOLLARS ($500), WHICHEVER IS LESS.

NOTWITHSTANDING THE FOREGOING, NOTHING IN THESE OFFICIAL RULES IS INTENDED TO LIMIT LIABILITY THAT CANNOT LEGALLY BE LIMITED OR EXCLUDED UNDER APPLICABLE LAW.

SOME JURISDICTIONS DO NOT PERMIT CERTAIN LIMITATIONS OR EXCLUSIONS OF LIABILITY. THEREFORE, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO EVERY PARTICIPANT.

15. Privacy

Information collected from Participants may be used to administer the Sweepstakes, communicate with Participants and potential Winners, fulfill Prizes, and otherwise operate Nuggets Night Vision’s business in accordance with applicable law.

NNV may use service providers and other vendors to assist with website hosting, email delivery, sweepstakes administration, data storage, Prize fulfillment, analytics, and other business functions.

By entering the Sweepstakes, Participants acknowledge that their information may be collected, stored, processed, and used as described in these Official Rules and the NNV Privacy Policy.

16. General Conditions

NNV reserves the right, to the extent permitted by law, to modify, suspend, cancel, or terminate the Sweepstakes, or any portion thereof, if fraud, technical failures, human error, security issues, interference, or any other circumstance compromises or threatens the security, fairness, integrity, or proper functioning of the Sweepstakes.

If the Sweepstakes is terminated before the scheduled end date, NNV may, where legally permitted, award the Prize by random drawing from all eligible entries received before termination.

NNV reserves the right to disqualify any Participant who tampers with the operation of the Sweepstakes or violates these Official Rules.

The failure of NNV to enforce any provision of these Official Rules does not constitute a waiver of that provision.

If any provision of these Official Rules is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect to the extent permitted by law.

17. Dispute Resolution and Governing Law

The Sweepstakes and these Official Rules are subject to all applicable federal and state laws.

Any dispute arising out of or relating to the Sweepstakes or these Official Rules will be handled in accordance with applicable law and any applicable dispute-resolution provisions contained in the Nuggets Night Vision Terms and Conditions.

Nothing in these Official Rules is intended to prevent a Participant from exercising any rights that cannot legally be waived or restricted.

18. Winner’s List

To request the name of the Winner for a particular Sweepstakes, send a self-addressed, stamped envelope to:

Requests must be received within seven (7) days after the applicable Sweepstakes Period closes.
